1. Acceptance
By accessing or using https://avo-gameroom-ecom.netlify.app(the “Site”) you agree to these Terms of Service. If you do not agree, do not use the Site. We may update these Terms from time to time; continued use after we post an update means you accept the change.
2. Eligibility
You must be at least the age of majority in your jurisdiction to place an order. By ordering you confirm you are legally able to enter into a contract.
3. Accounts
You are responsible for the security of your account credentials and for activity that happens under your account. Contact us immediately if you suspect unauthorized use.
4. Orders, pricing, and payment
Prices, taxes, shipping, and availability are confirmed at checkout. We may correct pricing or inventory errors and cancel affected orders with a full refund. Payment is processed by Stripe; we do not store full card numbers on our servers.
Online ordering may be unavailable while we update pricing and inventory. When it is, the catalogue on this Site is a guide to what we carry rather than an offer to sell, and orders are placed by phone or in the showroom.
Deposits and special orders. Tables, custom-built cues, and items we order in for you may require a deposit before we place the order. Deposits secure your build slot or the supplier order and are credited against the final invoice. Because these items are ordered or built to your specification, a deposit on a special order is non-refundable once the order has been placed with the supplier or the build has started, except where the goods are defective or we cannot fulfil the order. We will tell you which applies before taking a deposit.
5. Shipping and delivery
Cues, darts, and accessories ship by standard parcel carrier. Pool tables and game tables ship by freight and are scheduled separately. In our Winnipeg service area we deliver and install tables directly; outside that area, tables ship curbside and install is arranged on request. Delivery dates are estimates and not guaranteed.
Site readiness. Please confirm the room will take the table and that our crew can get it in — doorways, stairs, turns, and the playing space around the table. Our room size guide covers the measurements that matter, and we are glad to check them with you before you order. If a delivery cannot be completed because the space or the access will not take the table, redelivery and return freight are chargeable.
6. Returns and refunds
Unused items in original packaging may be returned within 30 days of delivery. Tables, cloth, and custom-built cues are non-returnable once installed or built to specification. Contact us before sending anything back so we can authorize the return and give you the right shipping path. Refunds are issued to the original payment method once the return is received and inspected.
Freight items returned by choice rather than because of a defect are subject to return freight costs and a restocking fee, which we will confirm in writing when we authorize the return.
7. Service appointments
Bookings for install, recovering, and repair are subject to crew availability and may be rescheduled by either party with reasonable notice. Quotes are estimates until the work is inspected on-site.
8. Intellectual property
The Site, including its text, images, logos, and code, is owned by us or our licensors and protected by copyright and trademark law. You may not copy, modify, or redistribute any part of the Site without our written permission, except as allowed by fair-dealing principles.
9. Disclaimers
The Site is provided “as is” and “as available.” To the maximum extent permitted by law we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
10. Limitation of liability
To the maximum extent permitted by law, our total liability for any claim related to the Site or your order is limited to the amount you paid for the order that gave rise to the claim. We are not liable for indirect, incidental, or consequential damages.
11. Governing law
These Terms are governed by the laws of the Province of Manitoba and the federal laws of Canada applicable in Manitoba. You agree to the exclusive jurisdiction of the courts located in Winnipeg, Manitoba for any dispute that is not resolved informally.
12. Changes
We may update these Terms from time to time. The “effective date” above shows the most recent change. Material changes will be communicated by a prominent notice on the Site.
